Law and Justice in Modern Perspective

The teachings of the legal mind (idee des recht) mention three elements of the legal mind that must exist proportionally: legal certainty (rechtssicherheit), justice (gerechtigkeit), and usefulness (zweckmäßigkeit). Justice is one of the most talked about legal goals throughout the history of legal philosophy. The framework of justice in a modern perspective refers to concepts and theories that seek to ensure that each individual is treated fairly and equally in various aspects of life. The modern perspective refers to how justice is viewed based on a modern approach. This reformulation often involves revising or improving legal rules, approaches, and law enforcement mechanisms to be more effective and fair by changing social, economic, and technological developments. As for the reformulation of the dialectic of modern law enforcement, it has the following characteristics: the theory of responsive law, the realist legal theory or legal realism, sociological jurisprudence, natural law provides an explanation of meta-juridical things, and critical legal studies.
