'The Restrained Claim in the German Civil Code (BGB) and the Insurance Contract Act (VVG)': The restrained claim constitutes a specific category of claims which, despite its high practical relevance, has to date been inadequately addressed in the literature and jurisprudence. This thesis clarifies the existing uncertainties, points of dispute and misunderstandings regarding the restrained claim. Furthermore, it identifies characteristics and criteria that can be used to classify claims as restrained in a legally certain manner, and develops proposals for legislative reform.
