The work analyzes the need to recognize and constitutionalize the human right to a dark sky in Peru in the face of the growing problem of light pollution. From a legal, environmental, and fundamental rights approach, the study examines how the excessive and inappropriate use of artificial lighting affects human health, biodiversity, ecosystems, and cultural heritage. Likewise, it addresses the insufficiency of the Peruvian regulatory framework and compares international advances in the regulation of this phenomenon. Finally, multidisciplinary measures -normative, technological, and educational- are proposed, aimed at mitigating light pollution and guaranteeing the protection of the night and common sky for present and future generations.
